A Jupiter, Florida man has been arrested by U.S. Marshals for allegedly tossing a 3.5 foot gator into a Wendy's in October.
U.S. Marshals have arrested a Florida man who they say scooped a three-and-a-half foot alligator from the side of the road and then tossed it into a fast food drive-thru window.
Joshua James, 23, of Jupiter, faces charges including assault with a deadly weapon stemming from the October incident at a Royal Palms Wendy's.
James was booked into the Palm Beach County Detention Center on Monday.

The Florida Fish and Wildlife Conservation Commission first filed a report on the incident in October, which included a photo of the gator on the floor of the restaurant.
“While the attendant has her back to the window and is at her register, the male driver reaches across the inside of his vehicle in the passenger area and throws an alligator from his vehicle into the drive through window,” reads the report, which FWC officials wrote, in part after watching security camera footage.
An officer who responded to the incident caught the gator and released it in a nearby canal.

After months of investigation, James was finally brought in for questioning in December. According to the FWC report, James admitted to scooping the animal up from the side of a road and, driving to the Wendy's, and throwing it through the drive-thru window.
On Tuesday, a judge ordered James to stay away from all Wendy's restaurants as well as to avoid possessing any weapons and submit to a mental health evaluation, WPTV reports.
At his first court appearance on Tuesday, bond was set at $6,000. If James fails a random drug and alcohol test his bond will be rescinded.
