Cops said Brittany Pennington, 24, and Johnathan Howard, 24, were parked next to the drive-thru lane in full view of the customers Monday.
According to the police citation, the married couple was seen inside a gray 1994 Ford Crown Victoria by drivers as they lined up to order from the drive through.
Pennington and Howard's bail was set at $2,000, The Smoking Gun reported. The couple has not yet entered a plea and will be arraigned later today, according to the Circuit Clerk at the Harlan County Clerk's office.

Police say Pennington and Howard admitted to the encounter, adding that it was a "mistake."
The Hardee's store in question did not comment when contacted by InsideEdition.com.
