Judge Sets Trial Date for Daniel Penny in Jordan Neely's Subway Chokehold Death

The Marine veteran charged with the chokehold death of a man on the New York subway was back in court. Daniel Penny was arrested for putting Jordan Neely in a fatal chokehold. Penny’s lawyers are comparing what happened to when a subway passenger shot a man with his own gun. No charges were filed with the Brooklyn DA ruling the shooter acted in self-defense. Now, Penny's lawyer says the two incidents should be treated the same. However, Neely's family says they are very different cases.
